2. Personal data we may process

Genera Energy does not request sensitive personal data through this website. Please do not include sensitive information in the form or in WhatsApp messages unless it is strictly necessary and there is an appropriate legal basis for processing it.

• Identification and contact data: name, email address and telephone number when provided.
• Professional or business data: the company or organization with which you are associated.
• Information you choose to include in your message, such as project location, energy needs, estimated demand or expansion plans.
• Technical connection data strictly necessary for website delivery, security and diagnostics that may be generated by technology infrastructure providers.

3. Purposes of processing

We do not currently use personal data collected through this website for secondary marketing purposes unrelated to the original request. If we later intend to use data for another purpose that requires consent, we will provide notice and obtain consent where required.

• Responding to information and contact requests.
• Preliminarily assessing energy needs and following up on potential projects.
• Communicating with the requester by telephone or WhatsApp.
• Preparing meetings, proposals or requested technical information.
• Maintaining the security, availability and operation of the website.

4. Contact form and WhatsApp

The website form does not itself send or store the information in a Genera Energy database. When you select “Send via WhatsApp,” your browser prepares a message with the information entered and opens WhatsApp so that you can decide whether to send it.

If you send the message, Genera Energy will receive the information through WhatsApp and process it for the purposes described in this notice. Use of WhatsApp is also subject to its provider’s own terms and privacy policies, which Genera Energy does not control.

5. Transfers and service providers

Genera Energy does not sell personal data. Personal data may be processed by technology or communication service providers acting on behalf of Genera Energy under confidentiality and data-protection obligations, and by authorities when required by law or a valid request.

Where a transfer to a third party requires consent under applicable law, consent will be requested before the transfer unless a legal exception applies.

6. Limiting use or disclosure

You may request limits on the use or disclosure of your personal data by submitting a written request at the address above or through WhatsApp at +52 444 199 7608. State “LIMIT DATA USE” and identify the data and processing you wish to limit.

7. ARCO rights and withdrawal of consent

You may exercise your rights of Access, Rectification, Cancellation and Opposition (ARCO) at any time, and may request withdrawal of consent where applicable.

A request may be initiated in writing at the address above or through WhatsApp at +52 444 199 7608. To protect your information, Genera Energy may require identity or representation to be verified through an appropriate channel before personal information is disclosed or modified.

The request should include the data subject’s name; an address or other means for receiving notices; evidence of identity or representation; a description of the personal data involved; the right being exercised; and any information that helps locate the data.

Genera Energy will communicate its determination within a maximum of twenty days after receiving a complete request and, when the request is granted, will implement it within the following fifteen days. These periods may be extended once for an equal period when circumstances justify it, in accordance with applicable law.

8. Retention and security

Personal data will be retained only for as long as necessary for the purposes described, to comply with legal or contractual obligations, or to establish, exercise or defend legal claims, after which it will be blocked or deleted as appropriate.

Genera Energy applies reasonable administrative, technical and organizational safeguards to protect personal data against damage, loss, alteration, destruction, unauthorized use, access or processing.

9. Cookies and similar technologies

This website does not currently include first-party advertising analytics or marketing cookies. Infrastructure providers necessary to deliver and protect the website may process technical connection information. When you follow links to external services, those third parties may use their own technologies under their respective policies.

Material changes to this Privacy Notice will be published on this page. The most recent update date will be shown at the top of the document.
